To supply CLEANING SUPPLIES as per the following:
* This contract is for one (1) year. There is an option to renew for one (1)
additional
year, upon agreement of both parties, with no changes to requirements or
pricing.
*Pricing is to be firm for the duration of the intial 1 year contract period.
*Any requests for price increases in the option year must be based on
significant price
fluctuations within the industry. All requests are to be submitted to the
Central
Purchasing Branch, in writing, at least 90 Days prior to the expiration of the
current
conract. The onus is on the successful vendor to submit documentation that
clearly
demonstrates the requested increase is based on changes within the industry.
The Province
of New Brunswick reserves the right to accept or reject any of these changes,
and all
decisions will be final.
* Vendors MUST provide WITH their tender submission, WHMIS and MSDS sheets dated
June 1,
2003 in both official languages. MSDS sheets MUST be supplied with EVERY
shipment.
* Test results indicating compliance with required standards MUST be provided by
an
approved certified laboratory and dated no later than 12 months from date of
submission;
these MUST be included with your tender submission.
* Testing methods may be requested as a backup to the certified test results
submitted.
* Should there be any dispute or question as to equivalency, samples may be
requested and
tested at RPC (Research and Productivity Council), Fredericton, NB in which case
those
results will be final. Costs for such testing will be borne by the vendor.
* Samples may be required to determine offensive odors prior to awarding of
tender.
* All products supplied under this tender MUST be:
- Water based except as noted.
- Include WHMIS label on all products.
- Have no measureable presence of:
Phenols (including compounds of)
Added fragrances
Extracts of nuts
Solvents and/or Petroleum products
Teratogens

CONTRAT PORTANT SUR L'ESTIMATION DE LA QUANTITÉ Pour livraison au fur et à
mesure des besoins pour la période indiquée, à la demande du Ministère. Les
quantités ou les valeurs en dollars mentionnées sont une estimation faite de
bonne foi et elles peuvent varier considérablement. La province du
Nouveau-Brunswick se réserve le droit d'acheter des quantités plus ou moins
selon les besoins.
Le présent marché est assujetti à l'Entente sur le Commerce Intérieur, à
l'Entente sur les Marchés Publics de l'Atlantique et à l'Accord de
Libéralisation des Marchés Publics du Québec et du Nouveau-Brunswick.
Lorsque les fournisseurs indiquent un prix unitaire dans une soumission,
celui-ci ne doit pas compter plus de quatre chiffres après le signe décimal.
Tout chiffre supplémentaire sera arrondi à la quatrième décimale.
*Les frais d'expédition DOIVENT être compris dans le prix unitaire.*
Les prix DOIVENT être fermes pour la durée du contrat.
Les vendeurs choisis doivent assumer TOUS les coûts engagés par le magasin
central du ministère de l'Approvisionnement et des Services dans le retour
d'articles qui ne répondent pas aux exigences du contrat portant sur
l’estimation de la quantité, y compris les frais engagés par l'utilisateur final
en retournant l'article au magasin central. Toute infraction à cette condition
peut entraîner la résiliation du contrat.
La marque, la description de l'article et la quantité doivent figurer sur tous
les contenants.
On doit trouver sur les boîtes des bordereaux d'expédition indiquant la
quantité, les articles et le numéro de bon de commande, sinon les marchandises
seront retournées au vendeur contre remboursement.
Le fournisseurs DOIVENT donner des renseignements sur les articles proposés
dans l'espace réservé. TOUT renseignement demandé doit être fourni, autrement
l'article ne sera pas examiné.
Le soumissionnaire peut inscrire ses propres numéros de produit s'il n'en
n'est pas le fabricant d'origine. Il DOIT aussi préciser clairement, dans les
espaces prévus à cette fin, le nom du fabricant original, la marque et le numéro
du produit, entre autres, sans quoi l'article sera refusé.
Lorsque plus d'un fabricant ou numéro de modèle figurent dans la
spécification, le soumissionnaire DOIT préciser clairement lequel fait l'objet
de sa soumission, sans quoi l'article sera refusé.
Tout article attribué en vertu du présent contrat portant sur l’estimation de
la quantité DOIT porter la même marque et doit provenir du même fabricant
original pour la durée du contrat, sauf si la province du Nouveau-Brunswick
donne son consentement écrit préalable.
La marque désigne une catégorie d'articles, identifiable par nom, qui est mise
sur le marché par un fabricant ou une entreprise UNIQUE.
Les vendeurs doivent accorder une attention particulière à l'unité de mesure
de chaque article et soumettre une offre tenant compte de l'unité de mesure
utilisée par la Province, laquelle peut différer de leur unité de vente.
Lorsque la Province demande des échantillons, ceux-ci demeurent la propriété
de la province du Nouveau- Brunswick pour une période de deux ans. Si le
fournisseur veut que les échantillons lui soient retournés à la fin de la
période de deux ans, il doit en faire la demande par écrit sur le bordereau de
marchandises qui est joint à chaque échantillon envoyé. Le fournisseur doit
préciser comment l'échantillon doit lui être retourné, à ses frais.
Le vendeur doit fournir les biens portant l'étiquette du fournisseur du SIMDUT
bilingues de même que les fiches signalétiques. S'il s'agit d'un produit
exempté, une lettre doit accompagner la soumission ou les biens.

Trailer Clauses:
ESTIMATED QUANTITY CONTRACT To be delivered as and when required for the
period indicated at the request of the department. Quantities or dollar values
stated are an estimate made in good faith and may vary considerably. The
Province of N.B. reserves the right to purchase more or lesser amounts depending
on requirements.
This procurement is subject to the provisions of the Agreement on Internal
Trade, the Atlantic Procurement Agreement and the Quebec-New Brunswick
Procurement Agreement.
When stating "Unit Price" on bid submissions, vendors are required to quote
pricings no more than four (4) digit positions after the decimal point. More
than 4 digit positions after the decimal point will be rounded-off to the fourth
position.
*Shipping Charges MUST be included in the Unit Price.*
Prices MUST be firm for Contract period.
Awarded vendors must carry ALL costs incurred by Central Stores, Department of
Supply & Services, for the return of any, and all products, that do not meet the
requirements of the Estimated Quantity Contract, including the cost of having
products returned by end-users to Central Stores. Failure to adhere to this
condition may result in cancellation of contract.
All containers must indicate brand name, item description and quantity.
Packing slips showing quantity, item(s) and purchase order number must be
included on the outside of carton(s) or shipment will be returned to the vendor,
collect.
Vendors MUST provide information on items bid in blank spaces provided. ALL
blank areas must be completed or item will not be evaluated.
Bidders may state their own product numbers if they are not the original
manufacturer, but they MUST also state clearly, in space provided, the original
manufacturer and brand, the manufacturer's product number, etc. or this item
will be rejected.
When more than 1 manufacturer and/or model number is listed in specification,
bidders MUST clearly note which one they are bidding, or this item will be
rejected.
Any products awarded for this Estimated Quantity Contract MUST remain the same
Brand and must be from the same original Manufacturer for the duration of the
Contract, unless prior written approval has been received from the Province of
New Brunswick.
A "brand" is defined as a class of goods identified by name as the product of
a SINGLE firm or manufacturer.
Vendors are to pay special attention to the "Unit" of Measure for each item
and bid in the Province's "Unit" of Measure, which may be different from your
selling unit.
When Samples are requested by the Province, the Samples will remain the
Property of the Province of N.B. for a two (2) year period. If vendors want the
sample returned after the two (2) year period, this must be requested in writing
on the packing slip, attached to each individual sample, when submitted. On
this request the vendor must state the method of return that will be charged to
their company.
The supplier must supply goods with bilingual W.H.M.I.S. supplier label and
M.S.D.S. data sheets. If the product is exempt, a letter must accompany the bid
or the goods.
